Indemnity and Damages
Our indemnity and damages agreement will need to be completed by all guests. We dont always ask for a damage deposit and rely on our guests honesty to sort out breakages.
In consideration of foregoing, and of the mutual covenants contained herein, the receipt and sufficiency of which are hereby acknowledged, the parties to this Agreement hereby agree as follows:
1.1 The Tenant agrees to indemnify and save the Host, harmless from and against any and all claims, liability, loss, expenses, suits, damages, judgments, demands, and costs (including reasonable legal fees and expenses) arising out of (i) the acts or omissions of Tenant, and his/her Family and visitors in connection with “Paulshof Guesthouse” property and ; or (ii) any accident, injury or death to persons, or loss of or damage to property, or fines and penalties which may result, in whole or in part, by reason of Paulshof Guesthouse House rules except to the extent that such damage is due solely and directly to the negligence of the Host.
1.2 The Tenant shall defend and settle at its sole expense all suits or proceedings arising out of the foregoing.
1.3 The obligations of the Tenant under this Indemnity Agreement shall last in perpetuity.
1.4 Any failure or delay by either Party to exercise any right, power or privilege hereunder or to insist upon observance or performance by the other of the provisions of this License Agreement shall not operate or be construed as a waiver thereof.
2.1 The Tenant and his/her Family and visitors agrees to, in connection with “Paulshof Guesthouse” property, pay for loss of or damage to property and content, in whole or in part, by reason of theft or damage, to the extent that such damage is due directly to the negligence or actions, activities of the Tenant.
2.2 Such damages will be paid on production of a quotation from the Host’s appointed contractor. The contractor shall be appointed by the Host at their sole discretion.
2.3 Breakage deposit. Should a breakage deposit be received by the Host it shall be refunded within 7 days of the checking out of the Tenant after deduction of any costs for restoration of the breakages. The non-collection of a breakage deposit does not in any way release the liability of the Tenant to pay for any damages,
2.4 Should the deposit be insufficient to cover the damages the Tenant shall pay the difference on production of the quotation and difference calculation to the Tenant.
3. HOUSE RULES
The guesthouse is situated in a quiet respectable neighbourhood. The Tenant and his/her Family and guests agrees to abide by the house rules that are listed below and, in general conduct themselves in a respectful manner. Should any of these Guesthouse Rules not be followed then, at the sole discretion of the Host, the Tenant may be evicted without refund or compensation. Electricity will also be switched off remotely should the house rules be continually transgressed.
3.1 Noise Levels: Loud music and noise to always be at an acceptable level and be turned off at 10pm weekdays and 11:00pm Friday and Saturdays.
3.2 Visitors: The Guesthouse is for use of tenants that are paid for and under no circumstances are other guests allowed to visit the property without the express approval of the Host. Casual visitors are allowed for collection and dropping off only. Should the Tenant want visitors for an event this needs to be arranged prior and a separate charge will be levied.
3.3 Alcohol. Alcohol is allowed however the Tenant and his/her Family must behave in a respectful manner and observe all the rules of the Guesthouse.
3.4 Firearms and Drugs/Narcotics: These are forbidden completely.
3.5 Medical Conditions: These need to be disclosed to the Host.
3.6 Neighbours: Any interaction with neighbours to be cordial and polite.
3.7 Smoking: we are a non-smoking establishment. Under no circumstances is any smoking of any substance or any device, Hookah, or e-cigarette allowed inside. Should this occur people will be asked to leave the premises immediately.
4. Covid 19 declaration
The Tenant agrees, to assist the South African Government with their Defence against the Covid-19 virus, to complete the Medical and Travel Declaration and provide the information requested. The Tenant also agrees to have their temperature taken on arrival and accepts the entry will not be allowed if their temperature is above 37.5 Celsius.
